英国essay代写:Law education in the United States

2019-06-11 | 来源:51due教员组 | 类别:Essay代写范文

本篇essay代写- Law education in the United States讨论了美国的法学教育。

A few years ago, when I was an undergraduate, there were three movies and TV series that influenced my understanding of American law school and the legal profession. They were devil's advocate, legally blonde and love at harvard. Later my experience told me that I hoped to come to the us law school to find a "Kim tae-hee", which was basically a dream. So I made up my mind to be a legal "beauty", but then gradually found that what I walked was a "devil's advocate" of no return. I can only admit that American law school is not a place where dreams come true. It can only wake you up from your dreams. However, this may not be a bad thing, for only waking people can truly realize their dreams.

There are hundreds of law schools, large and small, and more than 100 accredited by the American Bar Association. These law schools generally offer three degrees:J.D., L.L.M. and S.J.D. The essential difference between these three degrees lies in the different purposes of degree setting. J.D. mainly provides a platform for people without legal background to systematically learn American legal knowledge. L.L.M. is designed to provide students with an effective and in-depth understanding of the American legal system who have received a bachelor's degree in law or equivalent. The S.J.D. degree is for those who have achieved some success in law and are interested in further study in some fields of law. To be clear, American law school degrees are not ordered from lower to higher. That is to say, the relationship between L.L.M. and S.J.D. is not the relationship between master of law and doctor in China. Students who want to apply for S.J.D. do not have to obtain the degree of L.L.M. first.

Unlike legal education in China, the United States does not have a bachelor's degree in law. If students in the United States want to start their law school career, they generally choose J.D., because most of them have no previous legal education and cannot apply to L.L.M. or S.J.D. In fact, most native American J.D. applicants are recent undergraduate students or those who have just started working for a year or two. Most law schools advocate diversity of students' backgrounds. If the undergraduate major has nothing to do with law, it will not hinder the application of J.D. degree, but will help, because if your undergraduate major is unique and conducive to promoting the diversity of law schools, law schools will be willing to admit you.

L.L.M. 's student body is very different from J.D.' s, and consists largely of international students in the United States. These international students should have earned at least one law degree before applying for an L.L.M. degree, and there are generally no specific requirements for where or what to do. I even knew a student majoring in diplomacy in China who applied for L.L.M., because his undergraduate school issued a bachelor's degree in law for diplomacy. There are also a lot of students who did not study law in their undergraduate years, and can successfully apply for L.L.M. with the master's degree of law in China. Moreover, many, if not most, L.L.M. students chose to study in the United States after a period of legal practice. For these students, learning target is stronger, the efficiency is higher.

In contrast, the S.J.D. degree is more "professional" because the student who chooses to pursue it has a deep understanding of the U.S. legal system and intends to do more research in a specific field. This degree is similar to the ph. d. in science and engineering, students need to have their own regular tutor, and to complete their studies, they need to write a high-quality, publishable academic paper. As a result, the vast majority of students apply to S.J.D. after completing J.D. or L.L.M. This is not inconsistent with my earlier statement that there is no upper or lower order of degrees, because students with J.D. or L.L.M. degrees are more likely to apply. In addition, S.J.D applicants need to contact the tutor in advance, so it is difficult for them to establish an academic relationship with the tutor without previous study experience, which will affect the application.

Applications to U.S. law schools begin in September and end in February through April of the following year. Students planning to apply to J.D. need to take the LSAT in advance, and some schools also require the toefl. Applicants need to send their application materials to LSAC and apply online through the institution's online application process. It should be noted that undergraduate students in China need to send their transcripts to LSAC in advance and have them evaluated by LSDAS affiliated to LSAC. Since the evaluation takes at least two to four weeks, applicants need to calculate the time so as not to delay the application. In addition, the law school adopts rolling admission, that is, the application is reviewed first, so students who apply first have a considerable advantage. It is suggested that students who are ready to complete all applications before December.

L.L.M. and J.D.'s programs are roughly the same in terms of application times and materials, but L.L.M. applicants are not required to provide LSAT scores and the application process is simpler. Most schools don't require applicants to evaluate undergraduate scores, but there are exceptions, such as New York university law school, which requires applicants to use LSAC's evaluation service. Therefore, applicants must read the requirements of each law school carefully. It should be noted that nearly all L.L.M. 's applicants need to provide toefl scores to prove their language ability.

The application of S.J.D. is relatively special. Applicants need to contact their tutors in advance. The whole application process will be greatly different due to different situations of applicants, so relevant discussions are not conducted here.

Most U.S. law schools offer roughly the same J.D. degree program. In the first grade, students are required to complete certain credits of compulsory courses, including contract law, property law, tort law, criminal law, civil procedure law, constitution and legal writing. Second year no longer set compulsory courses, all courses are elective nature, and no grades. In general,J.D. students take four to five courses each semester to meet the minimum credit requirement.

For an L.L.M. degree, most law schools do not have required courses, and the choice of courses is entirely up to the students themselves. And at most law schools,L.L.M. students attend classes with J.D. students in their second and third years, taking exams and grading together. In contrast to J.D.,L.L.M. has a more liberal credit limit, with students generally taking three or four courses per semester. And because L.L.M. students have a background in legal education, they tend to take "advanced placement" courses. For example, students who are interested in non-litigation law will choose business courses such as company law, guarantee law, securities law, arbitration law and anti-monopoly law.

S.J.D. requirements vary from law school to law school, and many schools set a minimum number of years in school. Most students leave law school after this year to work on their graduation thesis. In addition, schools generally have no curriculum requirements for S.J.D. degrees.

In law school, classes are usually held two to four times a week, with classes lasting between one and one and a half hours. In addition to the usual classes, there are seminars, which are usually held only once a week, but each session is relatively long. In us law schools, students spend most of their time previewing course material rather than completing assignments or reviewing after class. Pre-class preview mainly includes completing the reading content assigned by the teacher and self-learning related knowledge. The average teacher will assign 10-30 pages of reading before each class, and the teacher will cover all of them in class, so if you don't do the preview before class, it will be difficult to follow the teacher's pace. In addition, the law school USES "Socratic" teaching, in which teachers ask students questions at random locations. Making a mistake or not showing up for class doesn't affect your final grade, but it can be embarrassing if you're called on and don't preview the day's class.

Law schools in the United States aim at vocational training, so they have systematic employment guidance and provide relatively perfect employment channels. For J.D. students, there is an on-campus interview for their sophomore summer internship, called OCI, before the first semester of sophomore year begins. At this interview, influential law firms or other law-related organizations from across the country or local areas come to recruit, and the number and quality of the number and quality of the organizations can vary depending on the reputation of the school. After the first round of on-campus interviews, the recruiter contacts the candidate with a second round of phone calls. This is called Call Backs. Most J.D. students spend their days staring at the phone before getting a Call Backs from their favorite employer.

It's worth mentioning that J.D. students find internship opportunities through OCI and Call Backs in their sophomore summer vacation, rather than informal work opportunities. But it is customary for most employers to offer interns a formal job after graduation after the summer internship is over. As a result, many J.D. students settle on a job before the third grade. Even if a suitable employer is not found for various reasons, students can participate in a new round of OCI in the first semester of the third year, when the OCI offers the opportunity to work formally. In addition, most J.D. students spend their first-year summers interning at courthouses and other public institutions. Although these internships are basically for public benefit, students can also get valuable harvest and unforgettable memories.

For L.L.M. students, there is no similar OCI, since there are not many students in each school. But every year, New York university and Columbia law school organize two large interview sessions in New York, and the institutions that attend the interviews are basically similar to those that attend the OCI. But based on L.L.M.'s international background, most of the organizations that interviewed offered overseas jobs. There are also law firms that offer jobs in the United States, but in the long run, most employers want to bring employees with an overseas education back to their home country to take advantage.

Students with S.J.D.'s may prefer a career in teaching. The application for teaching will be a little more complicated, and there is a big difference between China and the United States. Due to the limitation of space, we will not elaborate here. American law school is a place where one's dreams end. The dream referred to here is not a person's ideal or dream, but an empty dream. Reading is a process of self-improvement, and self-improvement is to a large extent to enhance the understanding of self. Self-knowledge can make us more familiar with our own strengths and weaknesses, and easier to face the unknown and challenges. With the improvement of self-knowledge, self-consciousness will decline correspondingly, and with it comes the understanding and concern for others. When you care about others, you are considered "pretty" whether you are in law or not. On the contrary, when you are corrupted by interests and desires, whether you are a lawyer or not, you will be the "devil's advocate".
